§ 1 General
The relations between the Weingut und Steirische Weinkellerei Johann Schneeberger GmbH and our customers are exclusively regulated by the following Terms and Conditions in the version valid at the time the order is placed. The Weingut und Steirische Weinkellerei Johann Schneeberger GmbH does not accept diverging conditions imposed by the customer , unless the Weingut und Steirische Weinkellerei Johann Schneeberger GmbH has explicitly agreed to them in writing.
§ 2 Contract
Your order is considered an offer to us to conclude a contract. Once you have placed your order in our online shop at www.weingut-schneeberger.at, you will receive a confirmation via email which confirms your order and lists all details connected with it (order confirmation email).
This order confirmation email does not automatically express our accepting your offer; however, it shall inform you that we have received your order. A contract is concluded as soon as we send your order to you or ship it to you by our means of transport. The contract is concluded with the Steirische Weinkellerei Johann Schneeberger GmbH.
§ 3 Shipping
Unless agreed on differently, we deliver the order to the address provided by the customer. All goods are shipped as fast as possible. All products are subject to availability and so we may not be able to supply your order. We will not be liable for any delivery problems.
Deficient or incorrect amounts can only be accepted if commented on the consignment note.
§ 4 Payment
The Weingut und Steirische Weinkellerei Johann Schneeberger GmbH retains the title of the object of purchase until the purchase price including additional fees has been paid in full.
§ 5 Non-availability of a good
In case a good you have ordered is not available, you will be informed by us via email or telephone.
§ 6 Reservation of ownership
We retain the title of the object of purchase until the purchase price has been paid in full.
§ 7 Warranty
In case there is a fault in one of our wines even though we apply to rigorous quality standards, we kindly ask you to inform us on this immediately. You will receive a respective credit note for your next order.
§ 8 Data processing
When ordering goods in our online shop, you have to provide us with your full name, address, email address and telephone number. This data is used exclusively for processing your order and never shared with a third party.
§ 9 Place of jurisdiction
The exclusive place of jurisdiction for disputes arising from the business relationship for both parties is the the customer’s actions against us is the commercial court (Handelsgericht) in 8010 Graz, Austria.
§ 10 Child and youth protection
The minimum age for the purchase of wine and spirits/distillates is 16 and 18 respectively. In order to be able to apply to laws and other legal regulations the Weingut und Steirische Weinkellerei Johann Schneeberger GmbH has the right to only hand over the particular goods after the customer has proved having reached the minimum age by showing photo identification.
In case we have to refuse handing over the goods, the customer is obliged to compensate for the damage caused (e.g. the shipping costs).
